Last week was a full and productive week for The Flomenhaft Law Firm, PLLC. On Wednesday, September 4, Michael Flomenhaft obtained a Plaintiff’s liability verdict resulting in a favorable settlement in Supreme Court, Queens County. This was the second phase of the liability challenge involving a porter’s staircase fall. Establishing liability initially required prevailing on an earlier framed issue hearing to extinguish defendant’s special employer Workers Compensation defense. Neck, back injuries and TBI were claimed.

Two days later, at mediation, $4.5 million dollars was obtained in settlement in a labor law case. This was highly favorable as Plaintiff’s claims were beclouded by two subsequent motor vehicle accidents, impeaching surveillance, and multiple conflicting records on proximate causation regarding the neck, back and head injury claims.
