In collaboration with Raul Sloezen, Esq. on March 3, 2025, Michael Flomenhaft succeeded before Hon. Joseph E. Capella in Supreme Court, Bronx County in quashing the Order to Show Cause filed by the Lewis Brisbois law firm seeking contempt against the litigation finance company Pegasus Litigation Funding, LLC for refusing to comply with a subpoena to provide my client’s litigation finance records. Although courts have previously rebuked this gambit, it appears to be an increasing feature in the defense arsenal especially in TBI cases. We hope this decision will help build the firewall against this tactic.
